1. Introduction

These Terms of Service (“Terms”) govern your use of AYDAPAY’s digital money transfer services, mobile application, and website.
By accessing our platform or initiating a transaction, you accept and agree to these Terms.

These Terms comply with:

  • EU Payment Services Directive (PSD2)
  • Polish Act on Payment Services
  • Polish Act on Providing Electronic Services
  • EU Consumer Rights Directive
  • GDPR and Polish Data Protection Act
  • EU AML/CFT Directives (AMLD5 & AMLD6)
  • Card network (Visa/Mastercard) rules

If you do not agree to these Terms, you must discontinue use of the service.


2. Definitions

AYDAPAY / We / Us – AYDAPAY SP. Z O.O.
User / You – a natural person accessing or using AYDAPAY for personal purposes.
Service – digital money transfer services provided by AYDAPAY.
Single Transaction – a one-time transfer from card to card/bank account.
Sender – the User initiating the transfer.
Recipient – the individual receiving funds.
KYC – Know-Your-Customer identity verification.
AML/CFT – anti-money laundering and counter-terrorist financing requirements.
SCA – Strong Customer Authentication required by PSD2.


3. Scope of Services

AYDAPAY provides:

  • Card-funded money transfers
  • Payouts to a card or bank account
  • Exchange rate display before confirmation
  • Real-time notifications and transaction history
  • Customer support
  • Security, AML, and fraud-prevention tools

AYDAPAY does not:

  • open bank accounts
  • issue payment cards
  • hold customer funds long-term
  • offer loans or credit
  • provide investment services

Each transfer is processed as a single, independent transaction.


4. Eligibility Requirements

To use AYDAPAY, the User must:

  • be at least 18 years old
  • have legal capacity
  • use the service only for personal and lawful purposes
  • provide accurate and truthful information
  • pass identity verification if required

AYDAPAY may refuse service to Users located in restricted or high-risk countries.


5. Creating and Verifying Your Account

The User must:

  1. Register an account using valid personal information
  2. Verify their email and phone number
  3. Complete KYC/AML checks when required
  4. Provide accurate Recipient details

Identity verification may require:

  • ID or passport
  • selfie/biometric match
  • proof of address
  • occupation or source-of-funds information

Failure to provide requested documents may result in service restrictions.


6. How Transactions Work

Before completing a transfer, AYDAPAY provides:

  • total amount to be charged
  • fees clearly displayed
  • exchange rate (if applicable)
  • estimated payout amount
  • expected delivery timeframe

A transaction is executed only after:

  • successful card authorization
  • SCA authentication
  • AML/fraud checks
  • compliance with sanctions screening

AYDAPAY may block or delay a transfer if required by law or card-scheme rules.


7. Fees and Exchange Rates

  • Fees are shown transparently before confirmation
  • Exchange rates include AYDAPAY’s FX margin (if applicable)
  • Fees become final once the payout is executed
  • Additional fees from your card issuer are outside AYDAPAY’s control
  • AYDAPAY does not provide credit, overdrafts, or cumulative balances

8. Limits

AYDAPAY may apply limits based on:

  • AML risk profiles
  • card scheme requirements
  • regulatory obligations
  • transaction history
  • geography

Limits may change without prior notice for security reasons.


9. AML, Sanctions & Fraud Prevention

AYDAPAY complies with all AML/CFT laws.
This includes:

  • identity verification
  • sanctions list screening (EU, UN, OFAC, etc.)
  • transaction monitoring
  • fraud scoring
  • source-of-funds checks
  • reporting suspicious transactions to GIIF

AYDAPAY may:

  • block or cancel a transaction
  • request additional documentation
  • suspend the User’s account
  • deny service to high-risk customers

These actions may occur without prior notice if required by law.


10. User Responsibilities

The User agrees to:

  • provide truthful information
  • use only their own cards or authorized ones
  • ensure sufficient funds
  • keep credentials secure
  • comply with laws and these Terms
  • immediately report unauthorized use

The User must not:

  • use AYDAPAY for illegal transactions
  • engage in fraud or deception
  • attempt to bypass security
  • impersonate another person
  • send money on behalf of unknown third parties

The User is fully responsible for all authenticated activity.


11. AYDAPAY Responsibilities

AYDAPAY is responsible for:

  • executing authorized transactions
  • providing clear information before transfers
  • protecting User data
  • maintaining secure systems
  • complying with regulatory obligations

AYDAPAY is not responsible for:

  • incorrect information provided by the User
  • bank or card network delays
  • technical outages beyond AYDAPAY’s control
  • FX conversions done by the User’s card issuer
  • rejections by the Recipient’s bank

12. Complaints Handling

Users may submit complaints via:

A complaint should include:

  • full name
  • transaction reference
  • description of the issue

Response times:

  • 15 business days standard
  • 35 business days for complex matters

This follows PSD2 complaint resolution rules.


13. Termination of Service

The User may close their account at any time.

AYDAPAY may suspend or terminate access if:

  • AML/KYC checks fail
  • fraud or misuse is suspected
  • ordered by authorities
  • Terms are violated
  • technical/security threats arise

Data may be retained for 5 years based on AML law.


14. Data Protection (GDPR)

AYDAPAY processes personal data in accordance with:

  • GDPR
  • Polish Data Protection Act
  • PSD2
  • AML/CFT legislation

15. Security Measures

AYDAPAY maintains strong security controls including:

  • encryption
  • tokenization
  • biometric login
  • firewalls and intrusion detection
  • fraud-monitoring systems
  • secure hosting
  • regular audits

The User must maintain their device’s security.


16. Intellectual Property

All content, trademarks, logos, designs, and technology belong to AYDAPAY.

Users may not:

  • copy
  • distribute
  • modify
  • reverse-engineer
  • create derivative works

17. Service Availability

AYDAPAY strives for 24/7 availability but does not guarantee:

  • uninterrupted service
  • error-free operation
  • instant processing

Maintenance or outages may occur.


18. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland.
Disputes will be handled by courts in Warsaw, unless EU law requires otherwise.
